NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities
to be undertaken by the Yavapai-Apache Nation.

REQUEST FOR RELEASE OF FUNDS
On or about October 10, 2023 the Yavapai-Apache Nation will submit a request to the U.S. Department of Housing and Urban Development, Southwest Office of Native American Programs for the release of 2022 Indian Housing Block Grant Competitive Program Grant funds under Title 25 U.S.C., section 4101, et seq. of the Native American Housing Assistance and Self Determination Act, to undertake a project known as “New Construction of 16 Single-family Homes for Yavapai-Apache Nation Tribal Members” for the purpose of the construction of new homeownership homes for 16 tribal member families on Yavapai-Apache Nation Reservation lands in Camp Verde and Clarkdale, Arizona.

FINDING OF NO SIGNIFICANT IMPACT
The Yavapai-Apache Nation has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Yavapai-Apache Nation
Housing, 1500 E. Cherry Creek Rd., P.O. Box 3310, Camp Verde, AZ 86322 and may be examined or copied Monday through Thursday, 8 A.M to 5 P.M and Friday, 8 A.M. to 12:00 P.M.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the YavapaiApache Nation Housing Executive Director in person at 1500 E. Cherry Creek Rd., Camp Verde, AZ 86322 or by mail at P.O. Box 3310, Camp Verde, AZ 86322. All comments received by October 9, 2023 will be considered by the Yavapai-Apache Nation prior to authorizing
submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION
The Yavapai-Apache Nation certifies to the Department of Housing and Urban Development, Southwest Office of Native American Programs that Tanya Lewis, in her capacity as YavapaiApache Nation Chairwoman, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Department of Housing and Urban Development, Southwest Office of Native American Programs’ approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Yavapai-Apache Nation to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS
Department of Housing and Urban Development, Southwest Office of Native American Programs will accept objections to its release of fund and the Yavapai-Apache Nation’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Yavapai-Apache Nation; (b) the Yavapai-Apache Nation has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Department of Housing and Urban Development, Southwest Office of Native American Programs; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Department of Housing and Urban Development, Southwest Office of Native American Programs at 1 North Central Avenue, Suite 600, Phoenix, AZ 85004. Potential objectors should contact Department of Housing and Urban Development, Southwest Office of Native American Programs to verify the actual last day of the objection period.
